A Ditch Fix and a Notice: My Applewood Story

Hi, Applewood neighbors—Greg here with a twist in my ditch tale. On January 23, 2023, I received a 'Violation Notice' from Jefferson County Planning & Zoning. The reason? I’d tried to fix my irrigation ditch lateral culvert to keep my property from flooding after changes from the Cottages at Rolling Hills subdivision started in 2019. The notice read: 'Ditch and Culvert replacement under driveway, Access Permit Required.' It added: 'Notice to correct the violation within ten (10) days is hereby given. This will be your only notification. Failure to resolve the violation within the specified will result in immediate legal action.' That last line hit hard—for trying to keep my yard dry.  

Before this, I hadn’t been sitting still. I’d sent a 9-page letter to a County Commissioner, asking for help with the flooding, and my attorney had mailed a Cease and Desist letter to county staff, hoping to protect my ditch. The response was that it’s a 'private matter,' leaving me to figure it out. So, I fixed the culvert myself—only to get this notice, saying I needed a permit after all.  

Here’s the backstory: since 2019, the Cottages at Rolling Hills development has shifted water flow, putting extra pressure on my lateral until it couldn’t keep up. My fix was a practical step, but the county saw it differently, sending this notice instead of support. It’s a head-scratcher—after years of asking for help, the focus flipped to my repair effort.
